Terms & Conditions

GENERAL• Artist will contact client to inform them of the accepted commission. This will be done through Twitter or Email.• For 3D backgrounds, client should provide clear references to avoid unnecessary confusion and/or revisions.• Pricing for 3D throwable props typically depends on the topology and texture complexity of the model(s). Conceptualization also affects the pricing i.e. are reference sheets/online resources available or will the model(s) need to be concepted by the artist.• The artist does not accept rush commissions.COMMUNICATION• Client can choose to be contacted by Email or Discord.• Time zone differences may affect response time. The artist’s time zone is GMT +01:00.• Client shall receive updates at least once a week or more depending on commission progress.• Client will be updated when commission enters the next stage of development.STAGESAll background commissions usually follow the same development stages. 3D throwables typically only follow the first four stages.
These stages are as follows: Discussion, Blockout, Modeling, Texturing, Lighting, Animation, Post-processing.
Stages Breakdown:
Discussion: Both client and artist shall discuss the commission in detail. The client should provide clear references to avoid unnecessary confusion and/or revisions.
Blockout: The artist shall create a simplified version of the background to figure out the angles and composition of the scene. The artist may also setup some basic lighting and also the architecture of the background. Any props at this stage will be rudimentary in nature.
Throwables will be a simple mesh to get the proportions and scale correct.
Modelling: 3D assets will now be created to a high standard.Texturing: 3D assets will receive textures and shaders.Lighting: The overall scene will receive lighting polish and tweaks.Animation: Any physical animation elements will be added to the scene.Post-Processing: Any drawover elements will be added as well as video editing required.PAYMENT• Payment will be sent via PayPal• Payment structure is as follows: 50% upfront then the remaining 50% when work is complete.• Once the initial 50% payment is received, work on the commission will commence.• Additional payment plans available upon request but may incur additional costs.• Client shall receive an excel sheet containing a full breakdown of costs before agreeing to the final price or sending of any payments when applicable.• Client shall receive the final files/resources once final payment is made unless otherwise agreed upon by the artist.REVISIONS• Unlimited revision requests available during the Blockout stage.• Revision requests made after the Blockout stage can be declined at artists discretion.• Once the commission enters the post processing stage, all revisions/requests will be declined unless due to artist error.• Commission delivery times & price can be affected by the amount/scale of the revisions requested. Client will be made aware of this prior to these types of revisions/requests being accepted.PROCESS & DELIVERY• Once the initial 50% payment is received, work on the commission will commence.• Final delivery for backgrounds is 1-2 months from start date depending on commission complexity.• Final delivery for 3D throwables can vary depending on commission complexity, client will be given a rough delivery date prior to any payment being taken.• Client shall receive updates at least once a week or more depending on commission progress.• Client will be updated when commission enters the next stage of development.• Static backgrounds shall be delivered as 3840 x 2160 (4K), .PNG files unless specified.• Animated backgrounds shall be delivered as 1920 x 1080p, .MP4 file unless specified.• 3D Throwables shall be delivered as an .FBX with textures embedded.• Upon completion, client shall receive a link to a Google Drive folder, via pre-agreed communication method, containing all agreed upon files/resources.• Google Drive folder shall remain available to client for 1 month (minimum) after being made available.CANCELLATION & REFUND POLICY• Client shall receive full refund of any payments made due to cancellation by the artist.• If the client cancels the commission after work has commenced, the artist reserves the right to keep the initial payment made by the client.• The artist will not issue refunds based on client dissatisfaction after the client has approved the progress.RIGHTS & USAGE
Below are the rights & usage for both the artist and the client.
Failing to uphold this agreement can result in the client being blacklisted and/or fined based on severity.
The Artist:
• Retains all copyrights over the commission.
• Retains the right to post WIPs (Work in progress) online.
• Retains the right to post final versions online and in portfolio.
• Retains the right to post in publications such as artbooks etc.
The Client:
• Retains all Intellectual property rights of the commission subject matter.
• May use the commission for its intended purpose initially outlined prior to commission start date.
• Must credit the artist when publicly using the commission.
• Is not permitted to use the commission in any form of AI training.
• Is not permitted to mint commission as an NFT.
• Is not permitted to resell the commission commercially.
• Is not permitted to claim the commission as their own.
• Is not permitted to modify the artwork without the artist's consent.
• Is not permitted to redistribute the commission to others.
Client can request that the artist does not publicly discuss or post about the commission online until after a certain date or event etc. This request will be discussed between both parties but the artist reserves the right to decline the request.for any questions or enquires, please message me directly on Twitter: @Kream_VT
